1. Acceptance of Terms

By accessing and using the website of SAYF Media Ltd ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website constitutes acceptance of the modified Terms.

2. Use of Website

2.1 Eligibility

You must be at least 18 years old to use our website and book photography services. By using our services, you represent and warrant that you meet this eligibility requirement.

2.2 Permitted Use

You may use our website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the website or servers
• Transmit any viruses, malware, or harmful code
• Collect or harvest personal information of other users
• Use the website for fraudulent purposes
• Copy, reproduce, or redistribute our photographs without permission

3. Photography Services and Bookings

3.1 Booking Process

All photography sessions are subject to availability and confirmation. We reserve the right to refuse or reschedule any booking for any reason, including:

• Photographer unavailability
• Studio scheduling conflicts
• Weather conditions (for outdoor shoots)
• Suspicion of fraudulent activity

3.2 Pricing and Payment

All prices are listed in British Pounds (£) and include VAT where applicable. Prices are subject to change without notice. The price charged will be the price in effect at the time of booking confirmation.

Payment terms:

• A non-refundable deposit of 50% is required to secure your booking
• Full payment is due 7 days before the session date
• We accept bank transfer, credit/debit cards, and cash

3.3 Cancellation and Rescheduling

Cancellation by Client:

• More than 14 days notice: Full refund minus deposit
• 7-14 days notice: 50% refund of total fee
• Less than 7 days notice: No refund (full fee retained)

Rescheduling: One reschedule is permitted with at least 7 days notice at no additional cost. Subsequent reschedules may incur a fee of £50.

Cancellation by Photographer: If we must cancel due to illness, equipment failure, or other unforeseen circumstances, you will receive a full refund including deposit, or the option to reschedule at no additional cost.

4. Photography Session

4.1 Session Duration

Standard session durations are as specified in your booking confirmation. Late arrivals will result in reduced shooting time. We cannot extend sessions beyond the booked time without prior arrangement and additional fees.

4.2 Location and Weather

For outdoor sessions, we monitor weather conditions closely. If weather is unsuitable, we will reschedule at no additional cost. The photographer has final discretion on weather-related decisions.

4.3 Conduct

Clients and their guests are expected to conduct themselves respectfully. We reserve the right to terminate a session without refund if inappropriate behaviour occurs.

5. Image Rights and Usage

5.1 Copyright

All photographs remain the copyright of SAYF Media Ltd unless otherwise agreed in writing. Purchase of digital files or prints does not transfer copyright ownership.

5.2 Client Usage Rights

Upon full payment, clients receive a personal use license for their photographs, including:

• Printing for personal use
• Sharing on personal social media with credit to SAYF Media
• Display in personal spaces

5.3 Commercial Usage

Commercial usage rights must be purchased separately. This includes use in advertising, marketing materials, product packaging, or any revenue-generating activities.

5.4 Photographer's Portfolio Rights

Unless explicitly agreed otherwise in writing, we retain the right to use selected images for our portfolio, website, social media, and marketing materials.

6. Image Delivery

6.1 Delivery Timeline

Edited images are typically delivered within 7-10 business days after the session. Rush editing (48-hour delivery) is available for an additional fee.

6.2 Image Selection

The number of final edited images depends on your chosen package. Additional edited images may be purchased at £25 per image.

6.3 File Format and Storage

Images are delivered as high-resolution JPEG files via digital download. We retain backup files for 12 months after delivery. After this period, files may be deleted.

7. Limitation of Liability

To the maximum extent permitted by law, SAYF Media Ltd shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Failure to capture specific poses or moments
• Technical failures beyond our reasonable control
• Damage to personal property during sessions

Our total liability shall not exceed the total amount paid for the specific booking.

8. Indemnification

You agree to indemnify, defend, and hold harmless SAYF Media Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the website, violation of these Terms, or infringement of any third-party rights.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
